By accessing or using novaqube.com (the "Website") or entering into a service engagement with us, you agree to be bound by these Terms of Service. If you do not agree, please do not use our Website or services.

All quoted prices are in pounds sterling (GBP) unless stated otherwise, and are exclusive of VAT where applicable.

We reserve the right to refuse, cancel, or pause any service engagement at our discretion, including where work is unlawful, unethical, or where payment terms are not met.

5. Intellectual property

The Website and its content (text, graphics, logos, code, images) are owned by or licensed to Novaqube and are protected by UK and international copyright, trademark, and other intellectual property laws.

For client work: subject to full payment of fees, all final deliverables produced under a service engagement (source code, brand assets, designs) transfer to the client. Novaqube retains the right to display work in its portfolio and case studies unless otherwise agreed in writing.

You may not reproduce, distribute, modify, or create derivative works from any content on the Website without our prior written consent.

6. Privacy

Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

7. Limitation of liability

To the fullest extent permitted by law, Novaqube shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Website or our services.

Our total aggregate liability for any claim relating to a service engagement shall not exceed the fees paid by you to Novaqube under that engagement in the twelve (12) months preceding the claim.

Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under English law.

8. Indemnity

You agree to indemnify and hold harmless Novaqube from any claims, damages, or expenses arising from your breach of these terms or your misuse of the Website or services.

We may terminate or suspend your access to the Website at any time, without prior notice, for any reason, including breach of these terms.

For service engagements, termination terms are governed by the specific written agreement between you and Novaqube.

10. Governing law & jurisdiction

These Terms of Service and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.

You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these terms.
